Q. Is an employee who has exhausted their sick pay entitled to notice pay if dismissed on grounds of ill health?

Where an employee has exhausted their sick pay, whether they are entitled to payment during their notice period is a complicated question. It depends on the amount of contractual notice compared to statutory minimum notice. An employee who is going to be dismissed on the grounds of ill health is always entitled to receive notice, and the notice you have to give, will be the greater figure of the contractual notice period and the statutory minimum notice period. Section 88(1)(b) of the Employment Rights Act 1996 provides that the employee…

How Stay Interviews could help you keep hold of your best employees

I want to talk about the importance of listening to your employees. In HR, we conduct exit interviews when people leave the business to find out the real reasons for people leaving, as this may help us to identify and resolve any key issues in the business. But, in my opinion, the exit interview is often too late! In the current economy, we know how tough it is to find good people, therefore you need to know that your employees are here to stay, so I would like to introduce…

Want to know what keeps people at your company?

Sounds obvious doesn’t it – just ask them – but you’d be surprised by how many employers don’t! While this is a vital tool in gathering data to assess what prompts an employee’s exit, it’s too late at that point to retain them. Enter the stay interview — an opportunity to engage in a one-on-one conversation to ask current employees, “what keeps…

The law does not prevent employees from taking annual leave while on sickness absence. It would usually be in an employer’s interests to agree to an employee’s request to take annual leave, to avoid them accruing significant amounts of leave while on sickness absence. If it…

Let’s not talk about the Great Resignation, let’s talk about the Great Revelation!

Increased flexibility and greater autonomy during the pandemic afforded workers more time to spend pursuing interests outside of work and even spend more time with their children and partners, and most of us decided that we quite liked these changes! Companies that have remote workers tend to fall into two different types of remote working. Remote companies are either fully or partially remote. Sometimes, they also require people to work from a number of locations. However, central to the majority of remote companies is that most team members have the…

1.What should the employer do if an employee is reluctant to return to work as the coronavirus restrictions are lifted?
