Q. Does a term-time worker have to take all their annual leave during the school holidays?

The arrangements for taking annual leave should be agreed between the term-time worker and the employer. Generally, the arrangement will require the employee to take all their annual leave during the school holidays. The employer can designate periods during the school holidays to be the term-time worker’s annual leave, in which case the employee will usually not be required to book any annual leave. Alternatively, term-time workers can be required to book their paid annual leave during school holidays.

Employers should keep in mind that other employees will also want to take their annual leave during school holidays and should ensure that working patterns do not leave the organisation short-staffed.
